1. Who we are

1.1. These terms apply to purchases of the digital programme "Breathe for Stress and Sleep" (the Programme) from our store at payhip.com/BodyAwarenessInstitute.

1.2. The seller is Body Awareness Center OÜ ("we", "us"), a private limited company registered in the Estonian Commercial Register under registry code 14148717, at Telliskivi tn 49-39, 10611 Tallinn, Estonia. Email: info@bodyawareness.ee. Board member: Eryk Wiesław Dobosz.

1.3. The author of the Programme is Nisarga Eryk Dobosz. We publish and sell the Programme under a licence from the author.

1.4. Payhip. Our store runs on Payhip, a platform operated by Payhip Limited (company no. 08386910), 167–169 Great Portland Street, 5th Floor, London W1W 5PF, United Kingdom. For buyers in the EU and UK, Payhip acts as reseller for VAT purposes: it calculates, charges and pays the VAT due. At checkout, Payhip also shows you its own End User Licence (https://payhip.com/terms/end-user). Payments are made only through Payhip's checkout and are paid out to our PayPal account. We are responsible to you for the Programme itself, for these terms, and for support, refunds and complaints. If anything in Payhip's documents gives you fewer rights than these terms or the mandatory consumer law of your country, the rule that is more favourable to you applies.

2. The Programme and what you need

2.1. The Programme is a 21-day, gentle, educational breathing programme in English. It consists of:

All practices are slow and gentle. There are no breath holds and no forceful or connected breathing.

2.2. What you need:

You don't need a YouTube account. YouTube may show ads and process data under its own terms (see our Privacy Policy).

2.3. Availability of the audio (our commitment). We will keep the unlisted YouTube videos with the guided audio available for at least 24 months from your purchase. If we remove them earlier, or if a track or link stops working for a reason within our control, we will give you the audio another way (for example, as an MP3 download) at no cost to you. This is part of what you buy, and it forms part of the conformity requirements in section 7. Tell us at info@bodyawareness.ee if a link doesn't work.

2.4. The Programme is intended for adults (18+).

3. Price and VAT

3.1. The price is shown in euros (EUR) on the product page and at checkout. It is the final price you pay. For buyers in the EU and UK, it includes any VAT due in your country, which Payhip calculates, charges and pays as reseller. We do not add VAT or any other charges on top.

3.2. During the launch period shown on the product page, the price is €14.90 (incl. VAT). After it, the price is €24.90 (incl. VAT). The price that applies is the one shown at checkout when you place your order.

3.3. If we ever announce a price reduction, we will also show the lowest price applied in the 30 days before the reduction (or, if the Programme has been on sale for less than 30 days, the lowest price applied since it was first offered).

3.4. There are no delivery costs. Your payment provider may charge its own fees, for example for currency conversion.

4. Ordering and payment

4.1. Click "Buy now", enter your email address and, if asked, your country or billing address (Payhip needs this to determine VAT). Tick the required checkout boxes and pay.

4.2. Payment is made only through Payhip's checkout, with PayPal or by card through Payhip's card checkout. PayPal (Europe) S.à r.l. et Cie, S.C.A., or the card payment provider used by Payhip's checkout, processes the payment under its own terms. We have no separate payment account on the store, and we never see your card details. Payouts go to our PayPal account.

4.3. The contract is concluded when your payment is confirmed. You then receive an email receipt that contains our order confirmation (section 6.4). You can generate a receipt or invoice document from that email.

4.4. You can check and correct your details on the checkout page before you pay.

5. Delivery

5.1. The Programme is delivered immediately after payment, by email and on a Payhip download page. You can download the PDF up to 5 times per purchase. If you need a new link, write to info@bodyawareness.ee and we will send you one.

5.2. Your email address is printed on each page of the PDF, to protect the single-user licence.

5.3. If you haven't received the email shortly after payment, check your spam folder and then contact info@bodyawareness.ee. If we fail to supply the Programme, you may ask us to supply it. If we still don't supply it without undue delay, or within an additional period we have expressly agreed with you, you may end the contract and get a full refund (Estonian Law of Obligations Act § 62¹³).

6. Right of withdrawal (EU/EEA consumers)

6.1. As a consumer in the EU/EEA, you normally have 14 days to withdraw from an online contract without giving a reason.

6.2. For digital content, this right ends once supply begins, but only if all of the following apply: (a) before paying, you expressly agreed that we start supplying the digital content immediately, before the 14-day period ends; (b) you acknowledged that you therefore lose your right of withdrawal; and (c) we sent you a confirmation of the contract, including that consent and acknowledgement, on a durable medium (email).

This follows art. 16(m) of the EU Consumer Rights Directive 2011/83/EU (as amended by Directive (EU) 2019/2161) and § 53(4) point 7¹ of the Estonian Law of Obligations Act (võlaõigusseadus), with the confirmation required by § 55(1)–(2) of that Act.

6.3. At checkout, we ask you to tick a required box that gives this consent and acknowledgement. Your right of withdrawal ends when the download link is made available to you.

6.4. Our confirmation of your consent is in your receipt email. These terms are also included as a PDF in your download.

6.5. If you did not give this consent, or we failed to confirm it, you may withdraw within 14 days of your purchase. Use our online withdrawal form (a Google Form) at forms.gle/ieyD19ADcMHhJDvc9, or our printable withdrawal form, or send a clear statement to info@bodyawareness.ee, for example: "I withdraw from my contract for 'Breathe for Stress and Sleep', order email [your email]." We will confirm that we received it by email without undue delay, and refund your payment within 14 days using the same payment method.

7. Conformity and complaints

7.1. We must supply the Programme as described on the product page and in these terms, free of defects, together with any updates needed to keep it in conformity. This follows EU Directive (EU) 2019/770 on digital content and the Estonian Law of Obligations Act, §§ 62⁴–62²¹.

7.2. We are responsible for any lack of conformity that exists when the Programme is supplied and becomes apparent within 2 years (§ 62¹¹), or longer where the law of your country provides. If it becomes apparent within 1 year of supply, it is presumed to have existed at the time of supply (§ 62¹²).

7.3. If the Programme is not in conformity (for example, a corrupted file, missing pages or an audio link that doesn't work), you can ask us to bring it into conformity free of charge, within a reasonable time and without significant inconvenience to you. If we refuse, fail or cannot do so, if the defect is serious, or if it recurs, you may ask for a proportionate price reduction or end the contract and get a refund (§ 62¹⁴). You cannot end the contract if the lack of conformity is only minor. Refunds are made within 14 days (§ 62¹⁷).

7.4. How to complain: email info@bodyawareness.ee with your order email address and a short description of the problem. We will reply within 14 days.

8. Your licence

8.1. The Programme is licensed, not sold. When you buy, you get a personal, non-exclusive, non-transferable licence for one person to download, store, print and use the Programme for your own non-commercial purposes, on your own devices.

9. Health Disclaimer and Contraindications

9.1. The Programme is an educational wellbeing programme. It is not medical, psychological or psychiatric treatment, and it does not replace advice, diagnosis or treatment from a doctor or other qualified health professional. It is not intended to diagnose, treat, cure or prevent any disease.

9.2. Please read the full Health Disclaimer and Contraindications before you buy. If any of the conditions listed there apply to you, talk to your doctor (or therapist) before starting. Examples include pregnancy; epilepsy; heart or blood pressure conditions; serious respiratory conditions; recent surgery; a diagnosed mental health condition; or medication that affects your heart rate, blood pressure or breathing.

9.3. Never practise while driving, operating machinery or in water. Stop if you feel dizzy, unwell, panicky or overwhelmed.

10. Liability

10.1. We are liable under the law for the Programme being in conformity (section 7).

10.2. We are not liable for harm caused by using the Programme against the Health Disclaimer and Contraindications or the safety instructions, or for results that depend on your own circumstances, except where the law does not allow such liability to be excluded or limited. We do not exclude or limit liability for death or personal injury, for intentional or grossly negligent conduct, or for any other liability that cannot be excluded towards consumers.

10.3. For buyers who are not consumers, our total liability is limited to the price paid, as far as the law allows.

11. Personal data

We process your personal data as described in our Privacy Policy.

12. Governing law, disputes and complaints bodies

12.1. These terms are governed by Estonian law. If you are a consumer, you also keep the protection of the mandatory consumer-protection rules of the country where you habitually live (art. 6(2) of the Rome I Regulation (EC) No 593/2008). You may also bring a claim in the courts of your country of residence.

13. Changes to these terms

13.1. The version of these terms in force when you place your order applies to your purchase. You receive a PDF copy of it with your download.

13.2. We may update these terms for future purchases, for example after changes in the law, in Payhip's features or in how we supply the audio. Changes don't affect purchases already made, unless a change is required by law or only benefits you. Each version is dated.
